This guy sure has a lot of time on his hands ;-)

Legally there is no doubt: the example he shows is illegal since it 
infringes Fuji?s trademark. It is not illegal to sell aftermarket batteries, 
as long as you do not try to make it look as if they are original. And you 
are allowed to mention the brand in the description to indicate 
compatibility.
