I'm not a lawyer, and don't play one here ;-), but I believe that an image 
taken in a public place and included in a book of photos qua photos does not 
require a release.

I was about to upload a picture  when it occurred to me that I may
need a model release, because the book will be published as a "for
sale" item, which makes it a commercial use. Is this correct?
